Amarinder suffers setback: HC sets aside appointment of Chief Principal Secretary



In a setback to the Punjab government, the Punjab and Haryana High Court Wednesday set aside the appointment of Suresh Kumar as state chief principal secretary.
 
Kumar, who retired in 2016 as an additional chief secretary, was appointed as chief principal secretary to Chief Minister Amarinder Singh in March for a period of five years. He was put on the same pay scale as the Cabinet Secretary of the Government of India.
 
Justice Rajan Gupta ruled that Kumar, a retired Indian Administrative Service officer, was holding the post "in violation of Article 166 (3) of the Constitution" and thus the appointment was "null and void".

Suresh Kumar is considered close to Amarinder Singh and is seen as the most powerful man in the state after him.

A Mohali resident, Ramandeep Singh, had moved the high court against the appointment with a petition claiming that the appointment was against constitutional scheme and accepted norms.
 
His counsel had argued that the tenure of Kumar, had been made co-terminus with that of the government. He has been delegated the powers to oversee functioning of principal secretary to the chief minister which is a cadre post. "Thus, a public office, has been usurped by a retired IAS officer. This apart, there is no provision in the rules for bestowing rank of a cabinet secretary on a retired officer,” advocate H S Brar had told court.
 
Kumar, a 1983 batch officer, retired in 2016 as additional chief secretary. He had served at many positions in the state as well as at the Centre on deputation.

Kumar had also served as principal secretary to the chief minister during Amarinder Singhs previous tenure of 2002- 2007.

The High Court order is seen as a major blow to the Chief Minister, who is already grappling with controversies surrounding Irrigation and Power Minister Rana Gurjit Singh, who has since submitted his resignation.

VETERAN AKALI LEADER, former Punjab minister and a former secretary of the SGPC, Manjit Singh Calcutta is no more. He was a lot of things formerly, and presently, only a 'could have been.' But, then, he was a dissenter. 

Any objective obituary of this man would be incomplete without mentioning that he knew how to be a dissenter, and to remain one. Of course, there were other dissenters in the Akali ranks, but he remained one till the last.
Calcutta breathed his last at Amritsar's Kakkar Hospital where he was admitted on January 4 after his sugar level plunged and he suffered from chest congestion. He died at 6:30 am Wednesday morning. He is survived by his wife, a son and two daughters.

When Gurcharan Singh Tohra was unceremoniously removed as SGPC chief just before Khalsa Tercentenary celebrations of 1999, Manjit Singh Calcutta was among the five ministers who quit the Akali Dal in protest. One by one, the others – Mahesh Inder Singh Grewal, Harmail Singh Tohra, Inderjit Singh Zira and Surjit Singh Kohli -- gradually made their peace with the Badals, agreeing to either far lesser roles or reduced to wait for their turn in the queue for political spoils till eternity, or Badal's benevolence, whichever came first.

Tohra, who lorded over the SGPC for more than a quarter century and remained a Lok Sabha MP once and a Rajya Sabha MP five times, was a leader whose name today is a currency with little convertible value. Considered once the centre of Sikh politics, the world of politics saw his daughter and other kin sitting outside the door of Akali Dal's reigning Badals for an SGPC ticket, or even less. They eventually went to AAP where they now sit on the extreme margins of a party that is in danger of being on the margins itself. This is the kind of fate Manjit Singh Calcutta was successful in avoiding.

Over the years, Mahesh Inder Grewal became an apology of a spokesman for Badal, Zira found a toe-hold in Congress, Harmail Tohra clung on to the AAP bandwagon, and Kohli opted for political oblivion.
 

Manjit Singh Calcutta remained a consistent dissenter, even after Tohra mended fences with the Badals, and refused to sit at the feet of the father-son duo, a slot that was filled by Prem Singh Chandumajra, once a strong Tohra loyalist who is now part of the Badals' shouting brigade, an MP and someone with the art of extracting a deal for his son and political heir Harinder Pal. In Punjab's electoral deal making arena, it's often your soul or the halqa incharge, and most opt for the later.

Among the first Akali leaders to raise the issue of RSS' attempts to saffronise education, polity and society, Manjit Singh Calcutta during his stint as Higher Education Minister in the Punjab Cabinet under Badal, took exception when some Sikh rituals were carried out before the Republic Day celebrations in various districts in 1998.

Later, when Tohra formed his Sarv Hind Shiromani Akali Dal (AISAD), Calcutta would often attack Badal for failing to confront the BJP and the RSS, and Chandumajra would routinely call Badal "an RSS agent." 

Sources who were very close to Manjit Singh Calcutta said even a few months ago, he rebuffed an offer from the BJP for an important political role and said he would prefer to die an Akali. Chandumajra's party, meanwhile, now has an alliance with the RSS-guided BJP and few would remember that both, the deceased leader and Chandumajra, had once planned and carried out the Panthic Chetna Jagao-Punjab Jagao movement (Wake Sikh Religious Identity-Save Punjab), set up by the AISAD in response to the Rashtriya Sikh Sangat’s mobilisation.

When Tohra formed his Sarv Hind Shiromani Akali Dal (AISAD), Calcutta would often attack Badal for failing to confront the BJP and the RSS, and Chandumajra would routinely call Badal "an RSS agent." Chandumajra's party now has an alliance with the RSS-guided BJP while Calcutta rebuffed efforts by the BJP to rope him in even when the saffron leadership was keen to induct respected Sikh faces.

As political leaders unexceptionally brought in their sons and daughters, sons-in-law and daughters-in-law, and other kin into the business of politics, Calcutta kept his progeny away from the cesspool. His son runs a hotel in Amritsar, and while one daughter lives in Canada, the other is in Kolkata, the city that gave its name to her father.
 

In 2012, Manjit Singh Calcutta extended support to the Congress in Punjab, with the proviso that it was more a support for Amarinder Singh's leadership. In 2015, he did consider an offer from the Aam Aadmi Party but this was before the then AAP convenor Sucha Singh Chottepur was thrown out of AAP by Arvind Kejriwal.
Manjit Singh Calcutta had joined the SGPC in the late 1980s as a Secretary, soon after Operation Black Thunder, and remained in this role till 1998-99, enjoying a token salary of Rs.1 per month. While the SGPC did not make much of a mark during all those years, it probably did act as a countervailing force vis-à-vis the Badals in Akali polity, till the Badals finally succeeded in ousting Tohra and his men.

Meanwhile, the world changed. The Akali Dal changed. From Pardhan Ji meaning Gurcharan Singh Tohra, to Pardhan Ji meaning Sukhbir Singh Badal, Calcutta saw these tides of politics from the ring side. In between, he would poke and criticise the tiny versions of pardhan jis off and on - the likes of Badungars and Makkars - but never saw the balance being restored in the Akali polity.

The House of Badals will issue its perfunctory condolence and tribute, no doubt, but the dissenter would have little respect for it.

CHANDIGARH: In an explosive development in Punjab politics, the state Power and Irrigation Minister Rana Gurjit Singh, who was facing serious charges of a scam related to sand mine contracts, has finally resigned.

Sources, however, said this could bring little respite to the beleaguered Amarinder Singh government as the development may actually boost the morale of the opposition, particularly of the Aam Aadmi Party which has been in the forefront to demand the minister's sacking.

Rana Gurjit faced allegations of being the proxy man behind his former employee walking away with contracts of sand mines in Nawanshahr. 

The development may hardly gladden the hearts of either CM Amarinder Singh or Akali Dal's Sukhbir Singh Badal as both view AAP's Sukhpal Singh Khaira, who had been persistently upping the pressure on this issue, as an upstart and a challenge.

"Yes, I have resigned. Now, it is up to the Chief Minister and the party high command to take further action. In fact, I had resigned earlier also when my name was dragged into the sand mine auction controversy,” The Indian Express quoted the outgoing minister as saying. The newspaper had relentlessly pursued the story, coming up with a series of reports regarding the alleged links of Rana Gurjit with firms involved in the sand mine auction.

The Indian Express had recently reported that a contractor, who was sent to jail in December 2017 after large scale irregularities were uncovered in the irrigation department, "had partly funded the successful sand mine auction bid of Rajbir Enterprises, the firm in which Rana Gurjit’s former employee Amit Bahadur was a working partner."

Amarinder Singh would have little option but to accept the resignation of the minister he was seen as defending a little too keenly. The scandal took away the sheen from any claims of zero tolerance towards corruption.

Rana Gurjit's resignation comes just before the Punjab Congress top brass is to meet Congress president Rahul Gandhi in a couple of days.

Ironically, the resignation also follows a clean chit that the minister procured from a Commission of Inquiry which was tasked by the CM to probe the scam. 

The AAP, particularly its Leader of the Opposition, Sukhpal Singh Khaira, had been making allegations of Rana Gurjit having directly pumped money from his company into another firm, which, in turn, paid money for two sand mines in Saidpur Khurd and Mehdipur in Nawanshahr.

Rana Gurjit's resignation comes just before the Punjab Congress top brass is to meet Congress president Rahul Gandhi in a couple of days, and just after the minister procured a clean chit from a Commission of Inquiry set up by CM Amarinder Singh.

Khaira and his party had been seeking a CBI probe into the auction of sand mines in the state.

The contracts for the two mines were bagged by the minister’s former employees, Amit Bahadur and Kulvinder Paul Singh, at Rs 26.52 crore and Rs 9.21 crore, respectively. After the controversy broke out, the minister was accused of using his proxies to win the mining contracts, but he denied any involvement. 

Reports had brought out that as per documents submitted to the Ministry of Corporate Affairs, the address of a firm linked to sand contracts, RGS Traders Co, was the same as the address of Rana Sugars owned by the tainted minister as also the fact that the minister and his wife Rajbans Kaur had availed a loan of Rs 4.07 crore from the same firm, as per the documentation Rana Gurjit filed when contesting polls.
 
While the Congress government in Punjab was hit by such a serious charge of corruption by a Cabinet minister embarrassingly early, Amarinder Singh was never able to come up with a reasoned defence.  

As early as May 31, 2017, The Tribune had editorially commented that if Amarinder Singh hoped "to reaffirm his claim that the Congress indeed means to end corruption in the state, the least he has to do is to remove the minster from his position to facilitate a fair inquiry."

"Rana Gurjit Singh’s continuation as minister is untenable for reasons more than just the attempt to get his employees to corner mines. He handles two ministries — irrigation and power — and has apparent personal business interests in both. His company is selling power to the Punjab Government and many of the sand mines are in rivers that he is expected to guard. This conflict of interest was way too obvious for the Chief Minister to ignore in the first place," The Tribune had said in a scathing comment.

CHANDIGARH: Shiromani Akali Dal (SAD) president Sukhbir Singh Badal today said the Congress government was proposing to play a fraud with the industrial sector by promising power at Rs five per cent unit but actually delivering the same at even higher rates than those prevailing during SAD-BJP tenure.

In a statement here, the SAD president said, the proposed tariff plan, which had been promised since the last nine months and was expected to be implemented this month, had very cleverly cloaked the final cost which would be borne by the industry. "The tariff plan of Rs 5 per unit has a variable factor which includes an additional levy of Rs 195 per kva at 80 per cent of connected load besides electricity duty, octroi and infrastructure development fee. This effectively will make the tariff more than Rs 6 per unit. Small scale units, particularly those who don’t run for more than 12 hours per day will see their tariff going up even further because they will have to pay additional levy on sanctioned load whether they run their units or not”.

Terming the entire exercise as a cruel joke on the industry which had been promised a flat tariff of Rs five per unit by chief minister Capt Amarinder Singh, the SAD president said "you will see a majority of consumers getting even more enhanced bills than they received during the SAD-BJP tenure. This move will also make the small scale industry unviable as they will have to bear the brunt of variable charges”.
 
Badal said this was not all. The Congress government had recommended and implemented a draconian power tariff hike on domestic consumers in the garb of subsidizing the industry. "The truth is that the industry will not benefit and domestic consumers have been saddled with an unprecedented hike of 12 per cent with effect from April 2017. Besides this the government has also implemented a municipal tax equivalent to two per cent of power bills in municipal areas. "The SAD will not allow this injustice against both commercial and domestic consumers and will soon come out with an action plan to force the government to withdraw its arbitrary hikes and give power to both industrial and domestic consumers at a flat rate of Rs five per unit”, he added.

Speaking about the performance of the SAD-BJP government, he said the SAD-BJP did not raise power tariff for two consecutive years in 2015-16 and 2016-17. He said in fact the government slashed the energy rates for industrial users to promote growth in 2016. Small scale industry consumption rates were slashed by 38 paisa per unit, medium scale by 36 paisa per unit and large scale by 11 paisa per unit. "Besides this peak load hour restrictions were also removed”, he added.

CHANDIGARH, JANUARY 15: The Punjab government, led by Chief Minister Captain Amarinder Singh, has decided to introduce a system of self-declaration on land holdings by the beneficiaries of the farm debt waiver scheme to ensure that only deserving and eligible farmers get the benefit of the scheme.

It has also decided to exclude government employees and retired pensioners who pay income tax from the scheme to ensure that the poorest of the poor get its benefit. A notification to this effect will be issued soon, it was decided at a meeting chaired by the Chief Minister.

Such self-declaration should relate to the farmers’ land holdings in villages in Punjab as well as in other states, said the chief minister, pointing out that data from the secretaries of the cooperative societies could not alone be relied upon as they were all appointed by the Akalis during their regime.

Self-declarations, followed by random checks, would ensure fool-proof mechanism to plug any loopholes in the farm debt waiver scheme, said Amarinder, adding that it would also help prevent the Akali wrongdoings from adversely impacting the farm debt waiver scheme. These measures would help address the various concerns of the MLAs, he said, responding to the issues raised by the elected representatives regarding the implementation of the loan waiver scheme.

Chief Principal Secretary to CM Suresh Kumar explained to the MLAs how the phased implementation of the scheme would work. Waiver of loans for farmers who committed suicide would be taken up after the committee set up by the Vidhan Sabha in this regard submits its report, he added.

The MLA pointed out that there were many big farmers who had transferred a small part of their big land holding to their son/sons to take benefit of the cooperative loans, resulting in waiver of their loans despite their huge land holdings.

Some big farmers with land in Rajasthan but holdings less than 2.5 acres in Bathinda had been included in the debt waiver, leading to resentment, they said, suggesting that the government take affidavits about the land holdings before finalising beneficiary lists.

In fact, they said, some NRIs had also ended up getting the benefit of loan waiver, which should have been limited to the deserving small and marginal farmers.  There was a suggestion for issuance of waiver certificates district wise, with proper checking of revenue records to ensure that the real beneficiaries get the waiver.

The Chief Minister assured the MLAs that all steps would be taken by the government to prevent misuse of the waiver benefit and ensure that no undeserving farmer is able to take its advantage.
