Major Leetul Gogoi found guilty, likely to be court-martialled for Srinagar hotel incident




Major Leetul Gogoi who was in the news in April when he used a local, Farooq Dar, as a human shield and who is facing a Court of Inquiry (CoI) after being seen with a local woman in Srinagar hotel is likely to be court-martialled, according sources in the Army.

"Orders have been issued to initiate disciplinary action. The CoI has held him accountable for fraternising a local in spite of instructions to the contrary and being away from the place of duty while in an operational area,” an Army source said on Monday according to TheHindu report.

On May 23, Maj. Gogoi was detained by the police after a scuffle when he tried to get into a hotel with an 18-year-old local woman. Following this, the Army ordered a CoI to ascertain the facts.
 
Army Chief Gen. Bipin Rawat, during a visit to the Jammu and Kashmir shortly after the incident, said that action would be taken if Maj. Gogoi was found guilty. "If any officer of the Indian Army is found guilty of any offence, we will take strictest possible action,” he said.

After the CoI was ordered, earlier this month, a report reached the Srinagar based 15 Corps headquarters to recommend action.
 
'Human shield' incident in April

Maj. Gogoi was in the news in April when he used a local, Farooq Dar, as a human shield against those pelting stones during polling in the Srinagar Lok Sabha by-election. On this occasion, he was awarded a commendation card by Gen. Rawat in appreciation of his sustained efforts in counter-insurgency operations.

IS THE BJP about to indulge in some kind of political adventurism in Jammu and Kashmir with a politician now in the Raj Bhawan and the state Assembly in suspended animation?

Top BJP pointsman and strategist for Jammu and Kashmir, Ram Madhav, made certain observations pregnant with many hidden meanings, including the possibility of bringing back to life the state Assembly that went into a limbo after the Mehbooba Mufti government was effectively ousted.

Satya Pal Malik is the first thoroughbred politician in the last more than five decades to have become the governor of Jammu and Kashmir. Congress' Karan Singh, the blueblood Kashmiri royale, was the last such politician to grace the Raj Bhawan.

Of course, Jagmohan, who also held the gubernatorial position, was a consummate politician but he had come from the ranks of the bureaucracy. Prime Minister Narendra Modi, clearly on the advice and persuasion of Ram Madhav, has taken a big risk in putting Malik in a position that should ideally have been ceremonial but is executive in every sense of the word in Kashmir, often even when an elected government is in place.

In an article in the Indian Express, Ram Madhav has given many indications that a revival of the Assembly could well be on the cards, though he stopped short of stating it explicitly.

"The legislators have to be encouraged to actively undertake political and developmental activities in the state," Ram Madhav said, while underlining the importance of the BJP-led Centre appointing a politician as the governor.

In the wake of Kathua, when the chism widened 
 
Reminding that the Jammu and Kashmir legislative assembly, with 87 members, "is in suspended animation" and "has a tenure of over 30 months left,"  Ram Madhav left little to imagination when he wrote, "It is not the gun of the security forces or the pen of the bureaucrats that should be the permanent feature of governance; it must be returned to the political leadership sooner than later."

In order to buttress his "sooner than later" line of argumentation, Ram Madhav did not flinch from even quoting the former police officer, AM Watali, whose memoirs castigated all political forces: "Continuous denial of democratic rights to people and fraudulent elections are major causes of disenchantment of the people....Political space was never allowed to be widened."

Ram Madhav's tone remains respectful towards Mehbooba Mufti, even after the bitter parting. In fact, he liberally quoted anecdotes from Mufti-Vajpayee conversations in the past.

Madhav said Watali's observations may be a case of over-generalisation, "but the point about widening political spaces needs to be taken seriously." 

Ram Madhav claimed that the fact that a long line up of governors sent to the state of Jammu and Kashmir came from within the ranks of bureaucracy or military, the significance of the latest transition "shouldn’t be missed."

Lest any particular section of the Kashmiri polity takes exception to the latent moves in the power corridors of Delhi to awaken the Assembly and breathe life into it again, Ram Madhav's tone remained respectful towards Mehbooba Mufti. Not only had he left behind the "Mehbooba Mufti is lying” rhetoric far behind  in the past, he, in fact, liberally quoted anecdotes from Mufti-Vajpayee conversations in the past, and also invoked the spirit of Vajpayee's "Insaniyat, Kashmiriyat and Jamhooriyat” line of approach.

"(W)hat J&K badly needed at this juncture was a politician with a political vision — one who understands the significance of political activism and with whom the local politicians can relate," Ram Madhav said.

Ram Madhav's agenda is clear cut: Keep the National Conference on board, not let the rapport with the PDP sour beyond a point, and ensure that political activity in J-K is kick-started.

Ram Madhav has been the key interlocutor of BJP for Kashmir, and was the architect of the unwieldy, and some claim the illegitimate, alliance between the BJP and the PDP. Also, he was the one who called it off.

Of the many qualities of the new governor Malik, including his being "a lawyer by education and a politician with vast parliamentary experience of around four decades...a leader of great learning and knowledge," Ram Madhav also added another qualification. He said the new governor's "past friendship and association with leaders like Mufti Mohammad Sayeed has given him valuable insights into the politics and problems of J&K."

Political experts that Punjab Today spoke to, in both New Delhi and Srinagar, said just as the governor's agenda is clearly cut out — in Ram Madhav's words, accelerating development activity, resolving the governance deficit, and continuing with strong counter-terror measures — so is Ram Madhav's.

He needs to keep the National Conference on board, not let a special rapport with the PDP sour beyond a point, and ensure that political activity in the state is kick-started.
 

"It is even a matter that will decide the success or failure of Ram Madhav as the BJP's man for Kashmir. Madhav has been working hard to make a mark. Kashmir is a quagmire where many a political reputations are buried, but it is also a temptress that beckons those who aspire for political immortality," said a keen observor of Kashmir affairs who is also an advisor on Punjab Today's panel of editorial consultants.

The Amit Shah-Modi school of thought is not attuned to such politics. Ram Madhav may lose to his own.

The move to play around with the suspended animation state of Assembly is well timed since Kashmir is in any case set for some political activity as the outgoing governor NN Vohra had announced elections to local bodies.

Yaadein hee bachi hain bus! 
 
While, as Madhav said, the "new governor being a politician can be an effective interlocutor for initiating the dialogue process," the real test will be if Ram Madhav and the BJP can bring back to life the Jammu and Kashmir Assembly without any stake holder losing political credibility. 

It has 30 months of life left, but the Modi government has even fewer months left. Will it pile stakes in a gamble that is too notorious because it is the house of terror that invariably wins when any one stakeholder tries to cheat? 
 

Kashmir needs more democracy and more political action, but uninterrupted. The Amit Shah-Modi school of thought is not attuned to such politics. Ram Madhav may lose to his own if he is unable to convince them that political progress in Kashmir may bring more dividends than Kashmiri Muslim bashing. The quagmire beckons him, and so does the temptress. It happens when you do the politics of gun in the streets of paradise.

AS PRIME MINISTER Narendra Modi came under instant criticism for not making any direct reference to minorities in his Independence Day message delivered from the ramparts of the Red Fort on Wednesday, sources said but for a last minute decision to drop significant paragraphs from the speech, it could have turned the tables and sent the Opposition squirming.

"There was a lot of confusion in the final hours, and the last night address to the nation by President Ram Nath Kovind only further fuelled this confusion," goes the speculation.

President Kovind, in his televised address to the nation on the eve of the Independence Day, said, ‘Don’t let contentious issues distract us.’ It triggered a re-think in the core team of the prime minister that the draft paragraphs directly addressing the issue of lynching could take away focus from the imagination-arresting Gaganyaan and the September 25 launch announcement for the health assurance plan. 

Team Modi stepped back in the final hours and decided not to address the issue so directly, it is being speculated by many well wishers of the BJP and PM Modi.

भाईओ ओ बहनों, आज एक ऐसे विष्य पर भी मैं बात करना चाह रहा हूँ जिस के बारे सारा देश बात कर रहा है और मुझे इस बात का भी अफ़सोस है कि मुझे इस के बारे में बात करनी पड़ रही है। इस लिए नहीं कि बहुत से राजनीतिक विरोधी मुझ पे यह आरोप लगा रहे थे कि मैं चुप हूँ और इन खुल्लम खुल्ला हत्याओँ पर कुछ बोल नहीं रहा हूँ। इस तरह के विरोध-प्रतिविरोध आरोप-प्रत्यारोप राजनीती का हिस्सा हैं और उनका जवाब भी दिया जा रहा है। आज मैं सड़क पर अपने आप को गौ-रक्षक कहने वाली उस भीड़ से सीधे सीधे बात करनी चाह रहा हूँ - कान खोल कर सुन लीजिये। पहलू खान भारत माता का बेटा था, जुनैद भारत माता का बेटा था और क़ासिम कुरैशी इसी देश का नागरिक था। और यह नरेन्द्र मोदी है। तिरंगे के नीचे लाल किले की फ़सील पर खड़ा नरेन्द्र मोदी। तुम को लगता है कि मैं हिसाब नहीं माँगूँगा? 

The speech was originally drafted to pre-empt the opposition's strategy and to try and court again the minorities as well to reclaim the middle ground among the burgeoning, educated middle classes in India which abhor communal violence and want a full stop to all divisiveness in the social fabric.

It could also have been a huge opportunity for Prime Minister Modi to come up as a tall statesman on the Indian political horizon since that is a vacuum that even a Mamata Bannerjee or a Nitish Kumar cannot fill, forget about Rahul Gandhi who lacks political idiom.

It takes an orator like PM Modi to deliver a crystal clear message and rise several notches above the rest of the crowd. A comparison with the surgical strike could have been woven into this section, thus cleverly making it impossible for the Opposition to underplay the significance of the strikes against Pakistan.

Here is how a possible action plan could have been unfolded by the prime minister from the ramparts of the Red Fort against the lynchmob:

"हम पाकिस्तान की नाभि में स्ट्राइक कर के हिसाब बराबर करना जानते हैं, तुम तो यहीं कहीं छिपे फिरते हो, कभी किसी बेज़ुबान गाय के पीछे, कभी भैंस को गाय बताते। 

"हम एक एक को ढून्ढ निकालेंगे। भीड़ में छुप्प जाओगे, यह ना समझ लेना। सारी भीड़ की पहचान कर लेंगे। यूँ हमारी एकता के, यकजहती के टुकड़े टुकड़े ना करने देंगे। 

भाईओ ओ बहनों, यह असली टुकड़े टुकड़े गैंग है, गौ रक्षक नहीं हैं यह। गो रक्षक सम्मानिय नागरिक होते हैं। जानवर से प्यार इंसान बनाता है। हैवान अख़लाक़ की गली में जाता है, सड़क पर दंगाई करता है, भाईओ ओ बहनों, सड़क पर दंगाई करता है।  

Experts said it is well nigh possible that Team PM read different signs in President Kovind's words as he warned against allowing "contentious issues and extraneous debates” that might "distract us”. 

"The power to stay your hand is far greater than the power to strike with your hand and hinsa has no place in society,” Kovind said. 

The Team PM thought it must not send any signals of doing any ‘hinsa’ against any lynchmobs.

"We are at a juncture in our history that is very different from any period we have so far experienced… Universal access to electricity, the elimination of open defecation, the elimination of homelessness, the very elimination of extreme poverty is achievable and attainable. We are at a pivotal moment. Let contentious issues and extraneous debates not distract us,” said Kovind.

The Prime Minister's speech seemed to have followed the script guidelines set by President Kovind, and Modi confined himself to talking about Swachh Bharat, homelessness, and several other good things. 

In fact, experts think there was possibly a lot more in the original draft of the Prime Minister's speech, including the total tonnage of the fish caught in India, the much higher number of rats caught in mousetraps in FCI godowns since 2014, thus helping save hundreds of tonnes of foodgrains for our poor, the total volume of the grass cut by India's gardeners (malis) in the parks of various towns, the total number of FUKC t-shirts sold in our malls that signifies a larger awareness of brand value and the continuing popularity of cold-shoulder tops among women in cities that showed a homegrown response to climate change in the spirit of think globally, act locally. But all these references were pruned due to the length of the speech and the obtaining weather conditions at the Raj Path where most VIPs were fanning themselves due to much hot wind blowing their way.

The Editors Guild of India on Wednesday released a statement decrying "all attempts" by the NDA government to"interfere" with the independence of the media. It came after two senior journalists of different TV channels quit and said they were being asked to be less critical of the government. 

It also demanded action against the people responsible for such activities and that the government take note of such cases.

Here's the full text of the statement:
 
The Editors Guild of India condemns the manner in which the right to practise free and independent journalism is seen to be undermined by a combination of forces – some media owners’ inability to withstand political covert or overt pressures from the political establishment and frequent instances of blocking or interference in the transmission of television content that is seen to be critical of the government.

The past few days have seen senior journalists of at least two electronic media channels come out in the open to assert that their employers attempted to either tailor or tone down their content to make it less critical of the government, leaving them no choice other than resigning. At least one such instance has been reported formally in writing to the Guild. These instances are disconcerting.

The Guild decries all attempts on the part of the government to interfere in the free and independent functioning of journalists, either put under pressure directly, or through the proprietors. It also reminds media owners that institutional strength and respect is directly linked to editorial independence and undermining the former can result in curtailing the latter. It urges them to not cow down to political pressure being brought upon them by the government or any other forces. Owners and journalists have an equally shared interest in press freedoms and in resisting pressures.

Even more worrying are the recent instances where signals of television programmes critical of the government have seemingly been blocked or disrupted in a manner almost Orwellian. One TV channel has also shared with the Guild screen-shots and details indicating such interference. Such attempts strike at the root of media freedom and indeed the foundations of our democracy. These undermine the right to be informed and to hold the establishment accountable. This seems a brazen attempt to punish "unfriendly” news channels and silence inconvenient voices.

The Guild demands that the government take note of these instances of disruptions in television programme signals, investigate and explain how and under what circumstances these egregious violations are taking place. Suitable action must be taken against those who were responsible for such nefarious activities aimed at throttling media freedom. It must also assure the nation that either directly or through any proxies or agencies it isn’t involved in this activity. And if it isn’t, these saboteurs must be brought to book. Freedom of airwaves cannot be tampered with.

[2] The Guild also decries the tendency on the part of the government, and the political class in general, to use selective denial of journalistic access as a weapon. This has become worse when there are few opportunities to ask questions to those in public life or in official positions on public platforms like press conferences, which is a legitimate democratic right of journalists on behalf of all citizens. Denying this right and shunning journalists critical of you are unhealthy practices in a democracy. Unfortunately, it can also lead to one-sided coverage. This unhealthy and unfair practice must be avoided.

[3] In a related issue, the Guild decries the "cease and desist” notice served by a large corporate group on some newspapers in an effort to block the coverage of an important Defence deal. The company should withdraw this notice. And if it doesn’t, it should be resisted and. If needed, we hope the courts will weigh in for the right of journalists to investigate and raise questions.

[4] The Editors Guild of India is also pained and agitated to learn of the detention of Shahidul Alam, eminent photographer and educator, in Dhaka under the provisions of the Information and Communication Technology Act of Bangladesh. The Guild understands that Mr Alam’s detention is arbitrary and unreasonable. Highlighting the peaceful protests by school children and young people in Dhaka against the malpractices in the transport sector, resulting in deaths, is not a crime. The Guild stands behind Mr Alam and demands his immediate and unconditional release from detention.

TWO HOURS AWAY from Delhi, they admit they lynched a Muslim to death. Now, they say their army of gau rakshaks is ready to kill more Muslims, but they will make sure that this time no video goes viral.

It is all on camera now. And Lok Sabha will hear the echo on Tuesday. Lynchings are back in the discourse, perhaps even more firmly now as India inches closer to elections in Rajasthan, Madhya Pradesh and Chhatisgarh, and then 2019.
 
"Last time we assaulted and lynched a Muslim to death, we faced this hassle of police action because some over-enthusiastic kid made a video of the beating and killing and it went viral. In future, whenever we do something similar, I will ensure that no one makes any video. We will leave the mobiles at home."

His only regret is about the video: "Mana karte karte bachhe nahi maante uss time par."

The Lok Sabha is all set to explode on Tuesday over the issue of lynchings, thanks to an explosive undercover sting operation by the NDTV that showed self-styled gau rakshak men not only owning up their role in assaulting and killing Muslims, but proudly proclaiming it.

More shockingly, the prime suspect in a brutal killing in Hapur said he openly told the jailer immediately upon his arrival in the jail that he has committed "a full murder and a half murder."

He said he will carry out similar operations in the future too against any Muslim he suspected of slaughtering cows but he will take care that videos of such beatings and murders do not go viral.

"Pehla case huya hai aisa video banaane ka. Ab nahi banayenge. Mobile bhee ghar daal kar jayenge koyee kaam hoga agar aisa."

Qasim Qureshi was a meat trader. Samiuddin was a farmer. On June 18, both were lynched by a mob in Hapur, western UP. Qureshi died as a result. Samiuddin suffered serious injuries. In the words of Rakesh Sisodia, it was "one full murder, one half murder."

Nine people were arrested. Four of them are now out on bail. Among them is Rakesh Sisodia.

He told the judge in writing that he had no role in the attack and wasn't present at the spot. When the NDTV reporter, posing as a research scholar from the United States doing field research on RSS and Hindutva outfits, caught up with Rakesh Sisodia, he narrated in detail what he had done. 

Then, he also said he has firm plans to carry out more such killings. "Meri fauj tayaar hai...katwa denge khade-khade...Hazaar baar jail jaana pade, jaayenge." (My army is ready.... If anyone slaughters a cow, we will kill them and go to jail a thousand times.)"

Caught on hidden camera in his village Bajedha Khurd in Hapur, he said the police was in their favour, otherwise they would have languished in jail. Hapur is just two hours from Delhi. Sisodia was behind bars for just five-weeks. Now, he is preparing his army for future actions.

"I told the jailer that they (the victims) were slaughtering cows, so I slaughtered them," Sisodia told the reporter. He also narrated how people welcomed him with open arms when he was released on bail.

In the video that had gone viral, bystanders are heard saying that someone should give some water to Qasim who had been brutally thrashed. Listen to Gau Rakshak Rakesh Sisodia's account of what happened: "Maine kaha tujhe paani peene kaa haq nai hai, tune marti hui gaaye ko paani nai diya. Meri fauj tujhe choregi nahi."

The TV reporter also met one of the alleged assaulters/killers of dairy farmer Pehlu Khan who was lynched to death in April 2017 in Alwar. Meet Vipin Yadav in Alwar's Behror town. He, too, told the court he had no role in the killing. He is out on bail.

He, too, was caught on hidden camera, telling how they beat up Pehlu Khan for one and a half hour. He said it was he who had pulled out the keys of the truck and pulled out Pehlu Khan. "Maine zabardasti chaaabi nikal ke unko baahar nikaal liya...2 pickup ki chaabi mere paas hi thi, mere pocket me hi rah gai thi." (I had pulled him out of the truck. I had removed the keys and had forgotten that the keys were left in my pocket)."

Last month, in a poignant article in a national daily, social activist Harsh Mander, had described the Hapur killings thus: "The same frenzied gratuitous cruelty of the mob, the passivity of the bystander, the triumphant video-taping of the crime broadcast through the internet, the cynical silence of the country’s leadership, the cover-up by the police."

Now, there is videographic evidence of it all.

Mander described in words that are difficult to read for a sane human being: "A group of men caught both Qasim and Samiuddin, dragged them to an enclosed compound and beat them ruthlessly. Later they hauled them out into the open fields.

"There a large crowd had gathered, many of them boys in their teens. Here they assaulted the two men with anything they could find — iron rods, sticks, knives, daggers, screw-drivers, even pens. Through all of this, they taunted and humiliated the two men."

The NDTV expose will be telecast in detail on Tuesday night, along with a lot of reactions from India's political class. It will be difficult to watch, because you are a sane human being and it hurts. But then, that's exactly the reason you do not have a choice.   

"Aap ne kitna maara?” the reporter asked Vipin Yadav in Alwar. "Dedh ghante tak. Koyee ginti thodi hai.” (We beat him for one and a half hour. Who was there to keep the count?)
