CPI welcomes SC decision on Jantar Mantar, Boat Club; asks to open Matka Chowk to protests as well



CHANDIGARH, JULY 26: Whole-heartedly welcoming the significant decision of the Supreme Court to allow protests at Jantar Mantar and Boat Club, CPI's National Executive Member Dr Joginder Dayal today said the ruling dispensation at the Centre and in various states should learn from the spirit involved in the apex court's judgment.

"The decision of the Supreme Court will go a long way in extending relief to the utterly powerless and aggrieved citizens, and also signifies that the top judiciary can rise to the occasion and stand with the subaltern classes. The sooner the political parties learn from it, the better it will be," Dr Dayal said in a statement issued by the CPI's state headquarters in Chandigarh.

Dayal said while the Supreme Court has set aside the undemocratic order of the National Green Tribunal that had banned the protests at Jantar Mantar by citing reasons as specious as noise pollution, it is a pity that even in the capital of Punjab, protesters remain debarred from public places.

In Chandigarh, the administration has banished all protestors, irrespective of their grievances, to a site near the cremation grounds. "Do protestors need to tell the rulers or the dead about how their rights as citizens are being trampled on?" he asked.

He said even while the Boat Club is just a few yards from Parliament, the SC has not demurred from opening it for protests. "However, the Chandigarh Administration has banned any protests even at Matka Chowk which is a good 2 kilometres away from the Punjab Assembly. What is it that the rulers fear if farmers or labourers hold a dharna at the Matka Chowk?" he said.

Dr Dayal said people want to speak truth to powers that be, which are acting as deaf. "The farmers, teachers, employees, anganwadi workers or nurses don't come to protest to convince the dead that they have a just cause. Both Akali Dal and Congress governments have behaved in an equally undemocratic manner," he said.
 

Dr. Dayal said any democratic politics will be meaningless if it does have space for resistance, dissent, and the right to organise and protest in a peaceful fashion.

"If the rulers refused to see the spirit of the Supreme Court's decision, then people will be left with no other avenue except to resist in an aggressive manner. It will be a sad day when people will have more faith in the judgement of the Supreme Court than the government," he concluded.

Horrendous acts of mobocracy can't be allowed, create law against it: SC to Govt



AMID A RISE in number of mob lynching cases across India, the Supreme Court said on Tuesday said that "horrendous acts of mobocracy" cannot be tolerated and recommended the Centre to enact a separate law against lynching and vigilantism. Criticising government for its failure to stop mob lynching incidents, Supreme Court said the onus lies on both the Centre and State governments to check these incidents and create law against lynching. "It has to be curbed with an iron hand… no citizen can take law into his hands or become a law on to himself," said the top court. 
 
A bench headed by Chief Justice Dipak Misra also passed a slew of directions to provide "preventive, remedial and punitive measures" to deal with offences like mob violence and cow vigilantism. 
 
"The State is duty-bound to ensure law and order and to prevent mobocracy. Horrendous acts of mobocracy cannot be allowed to become a new norm and has to be curbed with iron hands" Court said. It said that states cannot turn a deaf ear to such incidents and asked the Centre and States to file compliance report on the issue. 

"No citizen can take law into their hands. In case of fear and anarchy, the state has to act positively. Violence can't be allowed," Supreme Court said. The top court passed the order on a plea seeking formulation of guidelines to curb such violent incidents in the country.
 
The court said the growing numbness of the ordinary Indian to the frequent incidents of lynchings happening right before his eyes in a society based on rule of law is shocking. The government should see the judgment as a "clarion call" in a time of exigency and work towards strengthening the social order.
 
The bench asked the legislature to consider enacting a new penal provision to deal with mob violence and provide deterrent punishment to offenders.
 
The judgment authored by Chief Justice Misra for the Bench, also comprising Justices A.M. Khanwilkar and D.Y. Chandrachud, said such law should be effective enough to instill a sense of fear in the perpetrators.
 
The court's order came on a batch of petitions, including one by social activist Tehseen S Poonawalla and Tushar Gandhi, seeking to curb violence by cow vigilante groups. Gandhi had also filed a contempt plea on some states, accusing them of not enforcing the earlier orders of the court. The apex court order is pertaining not only to cow vigilante violence but also regarding violence perpetrated by all vigilante groups.

Earier this month, the SC said that mob lynching is a crime no matter what the motive is and added that it is a law and order issue that is that is the responsibility of state governments. That is, the apex court said whether a lynching happens as a result of cow vigilantism or because people believe someone is a child abductor, it doesn't matter - lynching is a crime, period.
 
The apex court directed the Centre and state governments to file compliance reports with regards to the guidelines issued by it in four weeks, Live Law reported. The matter has been fixed for further hearing on 28 August.
 
On September 6 last year, the apex court had asked all states to take stern measures to stop violence in the name of cow protection, including appointment of senior police officers as nodal officer in every district within a week and acting promptly to check cow vigilantes from behaving like they are "law unto themselves". 

The apex court had sought response from Rajasthan, Haryana and Uttar Pradesh governments on a plea seeking contempt action for not following its order to take stern steps to stop violence in the name of cow vigilantism.

Social media rumours about child-lifters have claimed several lives by mob lynching in Maharashtra. Just on Sunday, five people were lynched - despite police intervention. So far, there have been 13 incidents of lynching related to rumours circulated through WhatsApp about suspected child lifters and kidnappers, resulting in the murders of 27 people, in less than two months. Fake Whatsapp messages whip up a frenzy in minutes and before any sanity can prevail, innocents have been clobbered to death. Mobs are mobilised in seconds because the message has reached scores at the same time, giving real-time details of the so-called suspects.

On Tuesday, the irrepressible Mani Shankar Aiyar, who once referred to Prime Minister Narendra Modi as 'neech aadmi' and before that as a 'chai wallah', went to a book launch event and ended up launching a controversy.
 
"I have always held that PV Narasimha Rao was the BJP's first prime minister and Atal Bihari Vajpayee was the last Congress prime minister of India," Aiyar told an audience at a book launch event in New Delhi.

The punch line was still to come: "Narendra Modi, the current head of government, is India's first Hindutva Prime Minister," Aiyar said.

Atal Bihari Vajpayee of the BJP was the first non-Congress Prime Minister to complete a five-year tenure. He ruled the country for 13 days in 1996, and then for for almost six years from 1998 till 2004. PV Narasimha Rao was the Congress prime minister (1991-96), often credited for ushering in liberal, pro-market economic policies.

Compared to Narendra Modi-Amit Shah times, Vajpayee pursued a soft Hindutva line while Narasimha Rao followed a right-wing economic policy approach. Aiyar emerged as the first Congressman, though suspended, to give a pithy formulation that Rao was the first BJP premier and Vajpayee was the last Congress head of government.

Mani Shankar Aiyar made the controversial remarks in the presence of former Vice President Hamid Ansari.
 
Among others present were Aditya Mukherjee of the JNU, Prof Apoorvanand Jha of the DU, and journalist Marya Shakil.

In fact, Aiyar went for the jugular when he endorsed the view that life for a Muslim in India has become too difficult.
 
The dyed-in-the-wool Congressman who has often proclaimed his close affinity to the Gandhi family in the past and holds late Rajiv Gandhi in high esteem, even read out a paragraph from "Saffron Flags and Skull Caps: Muslim Identity and the Idea of India" that could have made even many a Congress cadre cringe.
 
"It is not easy being a Muslim in India, it never has been... It was not easy being a Muslim when Indira Gandhi was prime minister; it did not become easier during the reign of Narasimha Rao. It is certainly not easier today," Aiyar cited from page 132 of journalist Zia Us-Salam's book, and then added to the loud guffaws of the audience: "This is not Modi bashing, though it is my favourite occupation." He said he was talking about "the nature of our nation today."

The quote was from a chapter titled "Not easy being a Muslim."

Aiyar said even the most successful Muslims in India, even those who are most well integrated in our society and those who are part of our political process are asking themselves how difficult it is to be a Muslim here in India. He specially pointed out to the presence of senior editor Shahid Siddiqui of the Urdu weekly Nai Duniya in the audience who is seen as being somewhat soft on the Modi regime.

"It is a question every Muslim asks himself or herself - why can't I be just an Indian? No one else has to ask this question, only a Muslim has to ask this question," Aiyar said.

Of course, it was not Modi bashing; he was bashing his own party leadership, too, a trait he has displayed earlier to much acclaim from some of India's left of centre intellectuals and elite.

"Both these ideas, the Hindutva idea of India and the Nehru-Gandhi idea of India, have rivalled each other for better parts of the century but Hindutva has been rejected time and again by Indians, and most specifically by the Hindus," Aiyar said.

He said the fact that Modi got only 31 per cent of the vote in 2014 proved that a larger majority of Hindus rejected the Hindutva idea of India. "Earlier, the Hindutva idea had only ideological backing, now it has got political backing also."

Former vice president Hamid Ansari was also present at the book launch at the India International Centre. 

Aiyar and other participants contended that while the phrase, "the idea of India," was coined by Nehru, there could be any number of ideas of India reflecting the country's uniquely pluralistic society.

Aiyar, in his speech, was not only hitting Prime Minister Modi hard but also bashed Narasimha Rao for his pro-corporate policies, and as any student of politics and economics can guess, any criticism of Narasimha Rao's policies is ipso facto criticism of former Prime Minister Manmohan Singh's approach.

As things currently stand, Congress supremo Sonia Gandhi needs an ageing Manmohan Singh by her side for credibility and the sense of calm that he brings with him, and can do without the maverick ways of an outspoken Mani Shankar Aiyar.

Where does Mani Shankar Aiyar look for hope? "Indians are beginning to speak up for India and that is where hope lies in 2019," he said.

While Mani said the book was about an issue "seminal to the survival of the concept of a secular nation as envisioned and guaranteed by the Constitution of India," historian DN Jha has termed the work as being about "the twists and turns in the history of our country ... especially during the period of Modi regime." 

Speaking at the book launch event, Prof Apoorvanand of the Delhi University recalled an incident from the days of Holocaust and described how children would pelt stones at the Jews being taken in a train to the Nazi concentration camps. "We are living in a time when people are cheering the killers," he said.

In a blurb comment in the book, Professor Apoorvanand said it was a "bold and frank account of the transformation of the relationship between Muslims and the Indian nation" as it "questions the civilized denial about the antagonistic othering of Muslims and their marginalisation."

"Mani is not helping his cause by bashing Narasimha Rao or Manmohan Singh's policies. It is one reason that a sharp intellectual mind like his is not the darling of the Gandhi family anymore, but then it is also the reason that people sickened with divisive politics and sick of a Congress that is not rising to the occasion have become admirers of Mani Shankar Aiyar," a member of the audience who has served in senior government positions told Punjab Today after the event.

BJP govt leaves decision to SC judges, takes no stand on 377



THE CENTRE HAS put the onus on Supreme Court to decide on the constitutionality of Section 377 of the Indian Penal Code that criminalises homosexuality in the country.
 
CJI-led five-judge Constitution bench is currently considering whether to strike down or read down provisions of Section 377 that penalise 'unnatural' sexual intercourse (including gay sex) between consenting adults.

"We leave the validity of Section 377, so far as it relates to consensual acts between two adults, to the wisdom of the Supreme Court, the Centre said today.

At the same time, the Centre urged the Supreme Court not to deal with issues such as gay marriages and property and inheritance rights as these are matters that can have many repercussions. 
 
The Centre made these comments in an affidavit filed by Additional Solicitor General Tushar Mehta.
 
The SC, on its part, gave a strong indication it plans to go ahead and  scrap the Section that criminalises homosexuality.

Under Section 377 of the Indian Penal Code, sex "against the order of nature" draws a jail term and a fine. Activists say the police uses the law to harass members of the LGBT community.

Once it decriminalises Section 377, "discrimination faced by the LGBT community in employment and in choice of vocation will vanish," said the apex court. Further, "his will help awakening in the society and help LGBT (lesbian, gay, bisexual, and transgender) community will be able to live life to the fullest," it added.
 
The Centre also told the Supreme Court that while it would leave the issue of decriminalising homosexuality to the court, there should be safeguards against bestiality and harassment of children. ASG Mehta told the court that "perversions" such as incest and bestiality should not be allowed.

To this, Justice Chandrachud, who is on the five-judge Constitution bench hearing the matter, retorted that the Supreme Court is not considering kinks in sexual behaviour. "We want that two gay men holding hands and walking down Marine Drive are not arrested," Justice Chandrachud said.
 
The Centre submitted its affidavit, stating its stand on the issue, on the second day of the hearing in the case. A clutch of petitions have called for scrapping of the law criminalizing gay sex, others asked the court for a relook into its 2013 judgment.
 
Yesterday, the bench said it would only examine the "correctness" of its verdict of 2013, which cancelled a Delhi High Court judgment that declared criminalizing gay sex between consenting adults was "unconstitutional".
 
Under Section 377 of the Indian Penal Code, sex "against the order of nature" draws a jail term and a fine. While prosecutions under it has been rare, activists say the police use the law to harass members of the LGBT community. A series of challenges to the law has followed a tortuous route.

A Delhi High Court order decriminalizing gay sex was overturned by the Supreme Court in 2013. Five years later, in January this year, the top court decided to take a fresh look into the issue after a bunch of petitions calling for it piled up.

Last year's landmark judgment on Right To Privacy brought hope for the LGBT community. The court said the rights of lesbian, gay, bisexual and transgender population are "real rights founded on sound constitutional doctrine".

IN A COUNTRY where aspirants move heaven and earth besides networking and encashing IOUs to get selected to crucial top jobs most IITs are awaiting a chairman for months and certain universities are managing without vice-chancellors?

Reports say the Modi government now has a seven-step filter in place for selecting just the right candidate for key institutions, and candidates are checked for what they said or did on their facebook/twitter accounts. The PMO also checks what opinions their peers hold about them, their social media profile and the comments they make about the BJP government, its policies and issues figuring in media debates.

A general perception audit, which basically means what a candidate’s friends have to say about him or her, is carried out and the views of his or her superiors, juniors and colleagues are sought and recorded.

A 360 degree study is made and an express clearance is obtained from the PMO, the Economic Times has reported.

Apart from a background check and Intelligence Bureau report, there is one obstacle that has frustrated even many heavyweight candidates.

"Candidates are assessed on their past association, professional, personal and ideological affiliations with the previous government or with organisations seen as anti-government in any way," the leading Indian financial daily reported.

"In all major appointments, Prime Minister Narendra Modi himself takes the final call," it said.

In case of certain appointments that require a nod of the President of India, three additional filters are in place. 

Many in the government that Punjab Today spoke to said there is a palpable fear among even extremely senior officials and they are now careful as to who they socialise with, what they say to a colleague in a pub or what they punch in their WhatsApp groups.

"You never know what post I may be up for three years from now and who could be in power at the Centre. I do not want to lose because of something I said over a couple of drinks to a senior colleague in a bar," said a secretary level officer.

The Economic Times report said "strong comments even by friends and associates of a candidate on social media can lead to the candidate’s elimination."

Another official with specialisation in a very niche field said he was not afraid about the integrity check but was worried about a regime that checks how a candidate is perceived. "With my blunt, no-nonsense ways, I have rubbed the wrong way enough people in my career who will be going all out to contribute to my ‘perception audit’, and will recommend me for a full tenure in each of Dante's circles of hell," he said.

All VCs of central universities need a nod from President Ram Nath Kovind. Incidentally, the Rashtrapati Bhawan has its own mechanism to carry out due diligence over and beyond what the government may come up with.

"There is great benefit in this system as anyone selected will then enjoy the complete trust of the government and this fact will also be known to all the colleagues. This smoothens the work culture and removes friction," said a strong supporter of the filtering process who works with a leading NGO that in turn works closely with the government and boasts of recommending many names for crucial posts. 

Many NGOs and think tanks, like the Vivekananda International Foundation, have been playing a key role in shortlisting and selecting candidates for key positions.

IGNOU, Tripura University and Visva-Bharati are currently awaiting vice chancellors. The Lalit Kala Akademi, the Indian Council for Historical Research and the National Gallery of Modern Art also had to wait a long time before the government supplied them with leaders, ostensibly filtered through an elaborate sieve.
