Asaram in jail: The unsung heroes of this disgusting saga



A RAPIST BELONGS in the jail, and someone like Asaram needs to remain there for the rest of his life. But a society that celebrates the fact that one so well connected socially and politically can also be made to face the deserving denouement must not overlook the exemplary courage displayed by some lesser known men and women in this saga.

Asaram could not have been in jail if Mahendra Chawla had flinched from standing up in the witness box.

The case would have been weaker if Rahul K Sachan had been a man a little less brave.

Mahendra Chawla, the prosecution witness, was later attacked because he spilled the beans on how Asaram, the fraudulent godman, would often call girls he found beautiful on the pretext of career counselling, and then molested them.

Sachan, an Ayurvedic practitioner and Asaram’s former physician, narrated how a woman he knew was raped by Asaram, that he saw him kissing or sexually molesting women in Pushkar, Bhiwani and other cities in Haryana, and was so courageous that he directly confronted Asaram.

Sachan also told about girls being made to abort pregnancies.

As you read this, Sachan remains missing. Untraceable. And we have never been out on the roads demanding to know where the man, who stood up to the kind of might Asaram and his cohort could manage, is.

He was attacked twice, including once on a court premises when he was there to stand witness. 

As you read this, Sachan remains missing. Untraceable. He has not been seen since November 25, 2015. The CBI filed a kidnapping case in 2016, and we have never been out on the roads demanding to know where the man, who stood up to the kind of might Asaram and his cohorts could manage, is. 

All of these witnesses' testimonies are now part of the 453-page judgment that sent Asaram to jail for life for raping a 16-year-old girl.

He has not been punished for the attack on Mahendra Chawla. He has not been charged for intimidation, attack, and possible murder of Sachan. He has still not faced the demands of justice in all these cases of intimidation, assault and murder.

Ajay Kumar, also a former disciple, was beaten by the fraudster's henchmen more than once. 

We haven't been out for him, either, with banners and posters in hand.

It's time we start a broad and intense conversation about a solid witness protection programme in this country, unless we chose to depend on the courage and bravery of a Sachan who is only missing today because he refused to flinch.

Manoj Kumar Vyas, a judge at the Jodhpur sessions court, was threatened to grant Asaram bail in the rape case. 

The husband of a woman who had accused Asaram of rape was stabbed and injured in Surat. 

Dinesh Bhavchandni had acid thrown on him because he had provided legal assistance to people who had spoken against Asaram.

Amrut Prajapati, Asaram’s doctor for 12 years, was shot dead outside his clinic in Rajkot, Gujarat, after he testified against him before a court. 

Akhil Gupta, a cook and aide of Asaram, was shot dead in Muzaffarnagar after he testified against Asaram in the alleged rape of two Surat sisters.

Kripal Singh was shot and died a day later in Shahjehanpur, UP.

Our young boys and girls saw a rapist being told he was a rapist, and look how he was dressed. That needs to change. The world will be better served if pictures of Asaram in prison attire emerge in the public domain.

People like Mahendra Chawla, Sachan and Ajay Kumar are the pivots in cases like this. The men and women who lost their lives in the pursuit of justice are the people we must celebrate.

It was not lost on anyone what Khatta Singh, the driver of Dera Sacha Sauda's disgraced head and rapist Ram Rahim went through. If Ram Rahim is in jail today, it is because former dera manager Ranjit Singh decided to circulate an anonymous letter that detailed the black deeds of the Sirsa fraudster.

Ranjit Singh was shot dead in 2002. The two women stood steadfast, and no one should be in doubt that they still face a grave threat to their lives.

It's time we start a broad and intense conversation about a solid witness protection programme in this country, unless we chose to depend on the courage and bravery of a Sachan who is only missing today because he refused to flinch.

The men and women who lost their lives in the pursuit of justice are the people we must celebrate.

As citizens, we sleep a little better when a rapist goes to jail. We will be more at peace when we stand up for a Mahendra Chawla, a Sachan or an Ajay Kumar.

Right now, we need to begin by asking this: Since when has the jail manual been changed for disgraced, disgusting rapists to ensure that an Asaram can come to court to hear the verdict in such fancy clothes?  

Our young boys and girls saw a rapist being told he was a rapist, and look how he was dressed. That needs to change. The world will be better served if pictures of Asaram in prison attire emerge in the public domain.

We may also choose to ask the media: why is it so hard to stop referring to a rapist as 'Bapu'? Surely, editors still read the headlines, no? They can at least act the day after, if not earlier.

Judge Loya's Death: Top academicians, civil society leaders urge SC to order probe



A NUMBER OF leading civil society activists and academicians across India have appealed to the Supreme Court to "reconsider the verdict" on Justice Loya's death, claiming that the "rejection of probe does not satisfy people's conscience."

Addressed to the Chief Justice of India and his companion justices, the activists, including Anand Teltumbde, Nandini Sundar, Paranjoy Guha Thakurta, Amiya Bagchi, Tripta Wahi, Sumit Sarkar, Jayati Ghosh,  and Zoya Hasan, said they were "deeply anguished" by the apex court's verdict ruling out any need for a probe into Loya's death.

A three-judge bench led by the CJI had concluded that Judge Loya's  death on December 1, 2014 at Nagpur was due to natural causes and that there is no ground for reasonable suspicion about the cause or circumstances of death that would merit a further inquiry.

The activists said such a conclusion was "based on the statements made by four judicial officers...to the Commissioner of the Maharashtra State Intelligence Department."

"We note with grave concern that these four judicial officers were neither asked to submit affidavits before the Supreme Court during the proceedings, nor were any cross examination of their testimonies permitted," they said, and added why these judicial officers were "being accorded special privilege when they have become witnesses in an investigation into a possible crime." 

"The word of any witness should be cross-examined and verified following legal procedures, in order to establish its accuracy. The reason for the three judge bench of the Supreme Court to make exceptions in this case, just because the witnesses claiming to accompany Justice Loya at the time of his death are judicial officers, does not appear reasonable and fair," the appeal to the SC judges said.

The activists said the death of Justice Loya and the apprehensions of foul play raised by his family members "have raised very serious questions regarding the independence of the Indian judiciary."

"We are sad to say that the three judge bench verdict does not satisfy people's conscience," they said, and urged the top judiciary to "reconsider the three judge bench judgement and order a Supreme Court monitored investigation into Judge Loya's death."

VP Venkaiah Naidu Rejects 'Untenable' Impeachment Motion Against CJI Misra



VICE PRESIDENT OF India and Rajya Sabha chairman Venkaiah Naidu on Monday rejected the impeachment motion against Chief Justice of India Dipak Misra by seven opposition parties.

"The motion presented by the MPs indicates a mere suspicion, conjecture or an assumption in the Prasad Education Trust case. The same does not constitute proof beyond a reasonable doubt required to make out a case of proved misbehavior,” says the order by Naidu.

The motion was rejected after Naidu held consultations with several constitutional and legal experts, including Attorney General K.K. Venugopal. He also spoke to former Secretary General of Lok Sabha Subhash Kashyap, former Law Secretary P.K. Malhotra, former Legislative Secretary Sanjay Singh, and senior officials of the Rajya Sabha Secretariat. In addition, he also seems to have held deliberations with K. Parasaran, who was the Attorney General during the Congress governments led by Indira Gandhi and Rajiv Gandhi, and was also a member nominated by the party to the Upper House.

The order said the conversation between third parties with dubious credentials cannot themselves constitute material evidence against CJI. "Going through the allegations mentioned in the notice, I am of the view they are neither tenable nor admissable. The allegations emerging from the case have a serious tendency of undermining the independence of the judiciary," it added

This comes after Congress and six other opposition parties on Friday moved a notice for the impeachment of CJI Dipak Misra, accusing him of five counts of "misbehaviour" and "misusing" authority.

The opposition parties had met Naidu and handed over the notice for the impeachment with signatures of 64 MPs of the Upper House. The MPs who signed the notice belong to the Congress, the NCP, the CPI (M) and CPI, the SP, the BSP and the Indian Union Muslim League (IUML). The leaders of these parties earlier met in Parliament and gave the final shape to the notice for impeachment.

The parties had briefed the media after handing over the notice to the Upper House chairman. While reviewing the notice, the Rajya Sabha officials had mentioned that making public the contents of a notice before it is admitted by the chair is in violation of parliamentary rules.

According to the provisions in the handbook for Rajya Sabha members, no advance publicity should be given to any notice to be taken up in the House till it is admitted by the chairman.

The move to propose impeachment notice against the CJI has led to a slugfest between the Congress and the BJP. Meanwhile, the Congress said that the CJI should consider recusing himself from judicial and administrative duties until his name is cleared. The BJP has said the Congress was trying to demean, degrade and denigrate the judiciary by moving the notice.

HE TOUCHED HER on her face. She has since washed her face several times. "Still not able to get rid of it,” she wrote. That’s how deep the stench of an unwanted touch goes. That’s how stupid even a resident of a Raj Bhawan can be. 

Such a sweet old man is Tamil Nadu Governor Banwarilal Purohit that when a woman journalist asked him a question at the end of a press conference, he extended his hand and touched her cheeks, patting her so lovingly, a beatific smile on his face.

The journalist did what a journalist is supposed to do: she put up the picture of the gubernatorial behaviour towards young women on social media. Complete with the picture, smile intact.

Now, when all hell broke loose, His Excellency has apologised. In writing. 
 
For the governor, it was "grandfatherly attitude.” For her, she could not be any more clearer: "You are wrong.”

Lakshmi Subramaniam, who had asked the question at Madurai Kamaraj University, has accepted Banwarilal Purohit’s apology but said she was "not convinced” that all that His Patting Excellency was doing was appreciating the inherent brilliance of the question that she had asked.

She, in fact, had called Purohit’s behaviour "unprofessional”, and told the world on Twitter to say it was "completely uncalled for the guv to touch a stranger without her consent, especially a woman.” She had even sent him an e-mail voicing her discomfort.

Now, His Excellency The Cheek Patting Governor has put the gubernatorial seal with India’s national emblem of four lions, with only three visible, to a rather rare use. It embellishes his apology letter to the journalist. Surely, that’s a purpose to which gubernatorial stationery had not been put to use so far in independent India.
 
On Tuesday, Governor Purohit was at a press conference about a sex scandal. He needed to clear his name in a sex-for-degrees scandal in which a woman professor has been arrested. The woman professor is heard telling four girl students in the video to be ready to perform secret services for some high and mighty in exchange for good academic marks and money transfer to their bank accounts. That audio clip went viral, and the Cheek Patting Governor’s name also figured in that clip.

At the end of the presser, Governor Purohit  opted to trigger a new row by patting the woman scribe. Consent is not something he cared for particularly. 

The incident took place when the 78-year-old Governor was about to leave the venue of the crowded press conference at the Raj Bhavan.

The woman journalist, who works with The Week, recalled the encounter on Twitter: "I asked TN Governor Banwarilal Purohit a question as his press conference was ending. He decided to patronisingly - and without consent - pat me on the cheek as a reply."

Calling it unprofessional behaviour, the journalist, Lakshmi Subramanian, said it was completely uncalled for to touch a stranger without consent.

"This, moments after he dismissed a barrage of questions about allegations of sexual misconduct against himself. Unprofessional behaviour - and completely uncalled for to touch a stranger without her consent, especially a woman," she tweeted.

Tamil Nadu's opposition party, the DMK, said the incident was "unbecoming" of a person holding a Constitutional post. 

DMK Rajya Sabha MP Kanimozhi tweeted "even if the intention is above suspicion, a person who holds a public office has to understand that there is a decorum to it and violating a woman journalist's personal space does not reflect the dignity or the respect which should be shown to any human being."

"It is not only unfortunate, but unbecoming of a person holding a constitutional post," DMK Working President MK Stalin said on Twitter.

The Governor had held the press conference after a Nirmala Devi, professor at Devanga Arts College accused of making tacit requests for sexual favours to her students on behalf of officials of the Madurai Kamaraj University, had claimed she knows the Governor, who is the chancellor of the university.

Meet Sachchidanand Hari Sakshi. Journalists often refer to him as Sakshi Maharaj. If You have heard the man before, and of him.

He has views about India's educated, aspirational younger generation. If you have ever put your arm around your boyfriend/girlfriend, ever tried to kiss her/him, put your head in her/his lap, hugged her/him tightly on a birthday as everyone sang Happy B'day To You, Sakshi Maharaj has a view about you. Also, about your boyfriend/girlfriend.

The world doesn't stop because a girl is raped, denied justice, meets the CM, meets top police officials, threatens to commit suicide, her father is framed, tortured, and then dies. Life goes on. In Lucknow, it must. The city also has a night life, and a number of night clubs.

He says couples are often seen engaged in vulgar acts in public places like parks, cars and motorcycles. He wants primetime television shows to discuss such vulgar behaviour of your boyfriend/girlfriend. 

"When these couples ride a motorcycle, they hug each other as if they both will eat each other." That was Sakshi Maharaj. (And I am jealous. Get a room, I'd say.)

Sakshi Maharaj was the rare species who had come out in support of disgraced Sacha Sauda dera head Gurmeet Ram Rahim, arguing that only one woman was against him while crores supported him. "Is one woman right or are crores of people right?” he had asked, and also added, "Ram Rahim is a simple man, so he is being harassed.” 

But on Sunday, April 15, Sakshi Maharaj did something really nice for the first time in recorded history, and that too, for India's urban, middle class, aspirational, hep, upstart, educated younger generation. Now he wants us to believe it happened by mistake.

"Let's Meet.

No, that's not what he said on Sunday evening, April 15. That's the name of the nightclub he inaugurated in the posh Aliganj locality of Lucknow, the city of nawabs, the finest of etiquettes, its famed tehzeeb, nautch girls and tunde kebabs.

Sakshi Maharaj, all of 62 years of age, whose idea of party attire is definitely original, did not bother about the current outrage among the general populace about the rape in Unnao and the sheer rage in the aftermath of the horrific tragedy in Kathua. 

Sakshi himself is from Unnao, but that's alright. The world doesn't stop because a girl is raped, denied justice, meets the CM, meets top police officials, threatens to commit suicide, her father is framed, tortured, and then dies. Life goes on. In Lucknow, it must. The city also has a night life, and a number of night clubs.

From Zero Degree Lounge & Disc at the River Side Mall, Gomti Nagar, to the Night Players Club near Lucknow GPO; De-Forbidden Lounge in Parag Chauraha, Aashiana Colony; Zust Lounge at R Square Building; to Alambagh's Ding Dong DJ Night, to Mr Big Boss Club & Bar near Bank of India in Gomti Nagar, Lucknow has certain riches that are visible in the night, and very audible too.
 
Sakshi Maharaj was adding to this richness of the city, a new star of the night.

He went ahead, cut the ribbon, posed for pictures, as the party lights around him created a surreal atmosphere. Sources said there were no bhajan karyakarm on at that time, neither was Rag Malkauns being played. The music was appropriate to the mood and the lighting and the setting. Mark the blues in the pictures.

The flashy, fancy invitation card was carefully designed. See the accompanying picture. There was no hurry. Someone had drafted it, made sure all the phone numbers were correct, gotten it printed, checked the proofs and distributed these. Not a task that one would have been able to pull off in the last 30 minutes.

But Sakshi Maharaj now says he was tricked inaugurating the nightclub. 

After his pictures showing him inaugurating the night club went viral on the social media, Sakshi lodged a complaint with SSP Lucknow, claiming he was invited to inaugurate a ‘restaurant.’ 

"I was in a hurry since I had to catch a flight to Delhi. It was only later that I came to know that it was not a restaurant but a night club,” his complaint said. He now wants investigation and registration of a case under section 420 of the IPC (cheating).

Not once had Sakshi Maharaj made any noise that an FIR should be lodged as per the statement of the minor girl who was allegedly raped by a BJP MLA in his own Unnao Lok Sabha constituency. There was no hurry in that matter, but he now wants a quick investigation into the inauguration of the nightclub.

Unlike in the case of the minor girl who was raped and whose father was framed and then tortured in custody, Sakshi is not leaving out any loose end this time. He has made a formal complaint to the UP BJP president, Mahendra Nath Pandey, naming former state BJP general secretary Rajjan Singh, for egging him on to take up the invite.

On the other hand, the owner of the club, Sumit Gupta, who distributed those invitation cards and was present throughout the inauguration, seems to have woken up. He now says the invites mistakenly referred to the restaurant cum lounge as "nightclub".
 
It is not clear why no one has been egging on Sakshi Maharaj to meet the minor girl raped in Unnao. Strangely, no one is even asking that question. 

The nightclub is owned by Rajjan Singh's son-in-law. He is claiming that the word "nightclub" appeared on the invite was a "typographical error”. He has also rushed to announce that no liquor would be served at this restaurant/nightclub, a statement that has broken the heart of many young revellers looking forward to tell their boyfriend/girlfriend "Let's Meet."

Now, they hope BJP leaders are just as truthful as they often are.

But right now, BJP leaders in UP are too busy to bother about what happened to the minor girl in Unnao. Most are buried in the hectic activity preceding the nomination of candidates for legislative council elections. Deputy CM Dinesh Sharma has taken upon himself to defend Sakshi Maharaj's swing to the nightclub, saying the sadhu may not have been aware of the reality.

Sakshi Maharaj has now said, "Iss sab se meri chhavi kharab huyee hai. Udghatan to door, main to night club ke paas se bhee nahi guzarta. (All this controversy has damaged his image. Forget inaugurating one, I do not even pass by a night club.)” Now, this is a claim that will render too much of Lucknow inaccessible for the MP. 

"Main sirf ek baat kehna chahta hun – yadi nightclub ke paas se guzarne se bhee MP Sahib ko parhez hai aur un ki chhavi dhoomil ho jaati hai, to woh unn sabhi yuva varg ke bare mein kya sochte honge jo nightclub jaate hain? Zahir hai ke woh sab to anti-national honge MP Sahib ki nazar mein. Nightclub jaane walon ke liye, daaru peene valon ke liye, dance seekh rahe logon ke liye, haath-mein-haath pakar kar sarrak par chalte yuvaon ke liye ek alag se Lok Sabha ka MP hona chahiye Lucknow mein,” said a young girl as she sushed a mixed group of boys and girls outside a mall in Lucknow.

Interestingly, Sakshi's representative Ashok Katiyar claimed that the sadhu MP was to leave for Delhi but a senior office bearer of the party took him to the function saying that it was organised by his close relative. Katiyar said it was all very sudden, but it was not clear how "suddenly" did the invites got drafted, designed, printed and distributed. Owner of the establishment Sumit Gupta has now said the "restaurant" will serve only vegetarian food.

So, no liquor, no chicken, no mutton. Not even egg bhurji. A senior journalist said he wanted to ask what kind of music will play at the club but then held back lest it leads to Anup Jalota bhent permanently wafting in the air. 

So, Let’s Meet at Lucknow’s newest hep joint, and soak in the ambience over a Mango Slice. (Don't even think of Katrina Kaif). And no, you can’t hold your girlfriend’s/boyfriend’s hand. That is considered vulgar. But you can sit on chairs — talk about young people having to sit cross-legged on the floor and keeping their hands folded is just plain rumour.

After all, it’s a restaurant. Rest is all typographical error. Like rape. Stop rapping about it.
