SC issues arrest warrant against Calcutta HC judge C.S. Karnan

The Supreme Court on Friday issued a bailable arrest warrant against justice C.S. Karnan, a sitting judge of the Calcutta high court, after he failed to personally appear before the apex court for the second time in a contempt case against him.

According to livemint.com,  a seven-judge bench of the apex court led by Chief Justice of India (CJI) J.S. Khehar had earlier extended the deadline for Karnan to make an appearance. "Warrants will be served by the Director General of Police concerned and will be bailable at Rs10,000,” the court said.

It is the first time that the apex court has served warrants or initiated a case of contempt of court against a sitting judge.

The court had taken suo moto cognizance of Karnan’s alleged misconduct while he was serving as a judge in the Madras high court. He was subsequently transferred to the Calcutta high court.

Justice Karnan had written to various dignitaries, including Prime Minister Narendra Modi, the CJI, the Union law minister and various sitting judges across high courts, alleging corruption against several sitting and retired judges in the country.

On 13 February, Karnan in a written reply to the apex court made allegations of caste bias against him by the seniormost judges of the apex court.

The apex court is also hearing another case against justice Karnan related to his transfer from the Madras high court to the Calcutta high court. At the last hearing, he had been allowed to appear in person for the proceedings.

The case will be heard next on 31 March.

Are you feeling defamed because of your personal feeling of greatness: Kejriwal's lawyer grills Jaitley

Are you feeling defamed because of your personal feeling of greatness: Kejriwal's lawyer grills Jaitley

Finance Minister Arun Jaitley appearing before the Delhi High Court, in connection with the Delhi and District Cricket Association (DDCA) defamation case, was grilled by Arvind Kejriwal’s counsel, Senior Advocate Ram Jethmalani, in an open court on Monday.

The Finance Minister, during the course of the cross examination, was subjected to many pointed questions, and was asked to explain how he called the damage to his reputation "irreparable and unquantifiable".

Jethmalani a former BJP leader, attacked the every basis of Jaitley’s contention of defamation that his reputation was tarnished stating that it was the Finance Minister’s own assumption that he was "great”.

He also accused Jaitley of influencing Chetan Sanghi, the Delhi government vigilance chief who handled the DDCA case, and persuading him to go back on his report.

"There is no objective rational reason, besides the value that you put on yourself?" jibed Jethmalani.

To which Jaitley replied, "The value I placed, towards loss of my reputation was only a small part of the enormous damage done."

"It was your personal feeling about your own greatness that cannot be quantified in physical measure,” said Ram Jethmalani while he asked Jaitley to explain the meaning of the word "unquantifiable” which he had used in his petition.

Jaitley replied that his views were based on what "my friends, well-wishers and others, both privately and in the media, who had expressed an opinion on the subject."

He argued, "Considering my stature, background and reputation, the loss caused to me and my reputation was so enormous that it was considered unquantifiable."

However, Jethmalani was persistent on the fact that the defamatory statement Jaitley alleges to have been made by AAP did not cause him any monetary damage.

"You have not suffered any monetary damage as a result of this. In other words, you have neither lost money nor income,” said Jethmalani

While the senior advocate questioned as to whether he has read the defamatory portions himself and was sure that they were defamatory in nature, Jaitley retorted for raising objections on his "common sense.”

"Don't insult my common sense. I've quoted them in supporting documents and they are on record,” said Jaitley.

Jaitley has taken AAP to court for accusing him of a role in financial mismanagement at Delhi's cricket body DDCA, which he headed for 13 years till 2013. He had filed a civil defamation case demanding 10 crores in damages.

The matter has now been adjourned by the Delhi HC to Tuesday.

Army jawan found dead after accusing senior officers of harassment in a sting operation

An Army jawan, who featured in a sting operation video exposing the Army’s ‘sahayak’ system, was found dead under mysterious circumstances. His body was found in an abandoned barrack in Deolali Cantonment in Maharashtra, The Times of India reported. The decomposed body of Roy Mathew, was found hanging from the ceiling, with doctors saying he possibly died three days ago. TOI quoted police sources who said Mathew had served in the army for 13 years. In the video which showed ‘sahayaks’ tending to the personal needs of officers, Mathew was seen as well.

After the video was posted online, an investigation had been launched against Mathew. He had been missing from his artillery unit since February 25. A police source told TOI, "It is being probed if Mathew, who was attached for ‘buddy duties’ with a Colonel rank officer posted as an additional officer at the Artillery Centre in Deolali, had felt tortured or harassed after appearing in the video.” The source also said that Mathew was being questioned by various officials after the video went viral online.

In January, Lance Naik Yagya Pratap Singh uploaded a video where he complained against the ‘sahayak’ system, saying the officers’ wives make the jawans go to beauty parlours and do household chores. He also alleged that they sometimes have to polish the shoes of officers. However, army chief Bipin Rawat had defended the system, saying the camaraderie between ‘sahayaks’ and officers is important.
