From today, these 5 new Income tax rules come into effect



The new financial year 2020-21 is starting from today (April 1). In view of the lockdown to check the spread of corornavirus, the government had earlier extended the deadline for filing income tax returns for 2018-19 as well as that for linking PAN with Aadhaar by three months to June 30. Here are some changes in income tax rules that will come into effect from April 1, 2020, as announced in Budget 2020:

1) New tax slabs, as announced in Budget 2020, will come into effect. However, the old tax slabs will also remain in effect, giving a choice to the individual to opt between the two.

Under the new tax rates announced in Budget, there is zero tax for income up to Rs.  2.5 lakh; 5% for income between Rs. 2.5 lakh and up to Rs. 5 lakh; 10% for income between Rs. 5 lakh and up to Rs. 7.5 lakh; 15% for income between Rs. 7.5 lakh and up to Rs. 10 lakh; 20% for income between Rs. 10 lakh and up to Rs. 12.5 lakh; 25% for income between Rs. 12.5 lakh and up to Rs. 15 lakh; 30% for income above Rs. 15 lakh.

But under this new lower tax rates, the individual will have to give up on a lot of deductions that could help reduce taxable income like standard deduction, the popular deductions under Section 80C, exemptions on house rent allowance, leave travel allowance (LTA) and the deduction on interest paid on home loans. Tax experts say whether an individual should choose the new tax regime or the old one depends on a case to case basis.

"The alternative tax regime will benefit relatively the young taxpayers as they would not be committed much to expenditures like insurance, tuition fees of children, etc. The same could also be said for senior citizen taxpayers as well. Availability of NPS deduction under both the options will certainly continue to give it a boost. The relief to startups for deferment of tax on ESOPs will certainly help ease cash flow issues for their employees on receipt of ESOP," said Sandeep Sehgal, director of tax and regulatory at Ashok Maheshwary & Associates LLP.

2) Dividends received from mutual funds and domestic companies will be taxable at the recipients hands. For example, dividends the recipients will earn from their mutual fund investments will be taxed at their slab rates. Earlier, the dividend was tax-free in the recipients hands but the mutual funds deducted a dividend distribution tax (DDT) at a rate of 11.2% for equity-oriented funds and 29.12% for debt-oriented funds.

The new tax regime from April 1 increases the tax burden on investors in higher tax brackets, while lowering it for people in low tax brackets. However, it is to be noted that TDS or tax deduction at source at the rate of 10% will be levied if the dividend received by an investor in a financial year exceeds Rs. 5,000.

3) If the employer's contribution exceeding Rs. 7.5 lakh in a year towards NPS, superannuation fund and EPF, it will taxable in the hands of the employee. This change in income tax rule will be applicable in both the old and new tax regime.

It should be noted that if an individual opts for the new tax slabs, he can still claim income tax deduction on employer contribution towards employee’s NPS account. If your employer is contributing towards your NPS account, a deduction of up to 10% of salary (basic + DA) irrespective of any limit qualifies for income tax deduction under Section 80 CCD(2). Central government employees enjoy a higher limit of 14% of the salary. For others, the limit is 10%.

4) For those who are buying house for the first time and if the value is up to Rs. 45 lakh, the government has extended the date for availing additional tax benefit by a year to March 31,2021. House owners who have taken loans to purchase homes up to Rs. 45 lakh will be eligible to claim an additional tax deduction of Rs. 1.5 lakh on interest in addition to the existing deduction of Rs. 2 lakh.

Earlier, this deduction was allowed on housing loans sanctioned on or before March 31, 2020.

5) In a relief to employees of startups, the new tax regime from April 1 allows deferment of tax payment on shares allotted to them under ESOPs or employee stock ownership plan. The new tax regime, from April 1, has deferred the tax payment from the exercise date to 48 months after exercise, cessation of employment or sale of shares, whichever is earliest.

Currently, ESOPs are taxable when the vested options are exercised by the employees.

PM ‘cares’ but for whom? What happened to the PM's National Relief Fund?



Prime Minister Narendra Modi's decision to establish the Prime Minister's Citizen Assistance and Relief in Emergency Situations Fund, or the PM CARES Fund, amid the ongoing COVID-19 crisis, has triggered a controversy with many questioning the logic behind it. 

PM cares. But about what? Organising mega shows for his friend ‘Dolan’ Trump while ignoring advisories by the World Health Organisation, asked a senior citizen soon after the announcement of the new relief fund to deal with national emergencies. Shouldn’t it had been called ‘INDIA CARES’?

Some were even less charitable and wondered why the PM needed to brand himself and make political capital out of a crisis of gigantic proportions?

Above all, why did the Government feel the need to launch a new fund when the Prime Minister National Relief Fund (PMNRF) has been there for all these years ?

The Prime Minister on Sunday apologized for the harsh lockdown and declared that he had no choice and he had taken the decision in the interest of citizens and the poor. This infuriated some people even more and they pointed out that the PM had not apologized for the delay, for poor planning and coordination, for not taking states into confidence and for not being transparent with people.

It is always " I, me and myself” with him, fumed a former bureaucrat.

On Saturday the government set up the PM-CARES Fund to provide relief to those affected by any kind of emergency or distress situation in the wake of the coronavirus outbreak. It will have the Prime Minister as the Chairman of the trust and include the Defence Minister, Home Minister and Finance Minister as its members. Citizens and organisations can go to the website pmindia.gov.in and donate to PM CARES Fund, a government notification said.

Joining the debate, historian Ramachandra Guha said the new fund could be a 'national tragedy'. "Why a new fund when a Prime Minister’s National Relief Fund already exists? And why the self- aggrandizing name, PM-CARES? Must a colossal national tragedy also be (mis)used to enhance the cult of personality?” he tweeted.
Sceptics questioned the centralized approach and wondered how the funds would be disbursed. Would the lion’s share go to NGOs with RSS affiliation and to the BJP-ruled states? Why not have a few chief ministers also in the Trust? Would the Trust disburse funds to the state governments?

9. What is the registered office address of the PM-CARES Trust?

10. Why are cronies like Akshay Kumar, Vijay Prakash of PayTM, Jay Shah of BCCI falling over each other to donate to this freshly baked Public Charitable Trust instead of the institutionalised PMNRF ?

"It’s called "PM CARES” but the money has to come from public donation. Meanwhile, tax payers’ money is splurged on statues, advertising, foreign trips and an insane plan to rebuild the central vista of New Delhi with 20k crores of public money’ .

India's leading digital payments and financial services platform Paytm has said it is aiming to aiming to contribute Rs 500 crore to the PM CARES Fund.. 
Adani Foundation has contributed Rs 100 crore while T-series honcho Bhushan Kumar has pledged Rs 11 crore.

Bollywood actor Akshay Kumar has given Rs 25 crore while cricketer-turned-BJP MP Gautam Gambhir contributed Rs 1 crore.

The coronavirus pandemic has driven the global economy into a downturn that will require massive funding to help developing nations, IMF chief Kristalina Georgieva said Friday.

"It is clear that we have entered a recession” that will be worse than in 2009 following the global financial crisis, she said in an online press briefing.

Over 80 countries, mostly of low incomes, have already have requested emergency aid from the International Monetary Fund, she said.

With the worldwide economic "sudden stop,” Georgieva said the fund’s estimate "for the overall financial needs of emerging markets is $2.5 trillion.”

But she warned that estimate "is on the lower end.”

Governments in emerging markets, which have suffered an exodus of capital of more than $83 billion in recent weeks, can cover much of that, but "clearly the domestic resources are insufficient” and many already have high debt loads.

"We do know that their own reserves and domestic resources will not be sufficient,” Georgieva said, adding that the fund is aiming to beef up its response "to do more, do it better, do it faster than ever before.”

The IMF chief spoke to reporters following a virtual meeting with the Washington-based lender’s steering committee, when she officially requested a increase in the fund’s fast-deploying emergency facilities from their current level of around $50 billion.

She also welcomed the $2.2 trillion economic package approved by the US Senate, saying "it is absolutely necessary to cushion the world’s largest economy against an abrupt drop the economic activities.

Debt relief for poor countries

In direct response to the Covid-19 crisis the International Monetary Fund (IMF) Executive Board has adopted some immediate enhancements to its Catastrophe Containment and Relief Trust (CCRT) to enable the Fund to provide debt service relief for its poorest and most vulnerable members.

The CCRT enables the IMF to deliver grants for debt relief benefitting eligible low-income countries in the wake of catastrophic natural disasters and major, fast-spreading public health emergencies.

The Covid-19 outbreak and the associated global economic turmoil creates a critical need to support the Fund’s membership, including exceptional balance of payments support for the poorest members especially impacted by the pandemic.

Well-targeted support will allow these countries to prioritise medical spending and health-related as well as other immediate needs in the challenging economic environment, characterised by sharp declines in income, lost revenue and higher expenses. In that context, the IMF Executive Board has approved changes to the CCRT that expand the qualification criteria to better cover the circumstances created by a global pandemic and to focus on delivering support for the most immediate needs.

Specifically, the decision will allow all member countries with per capita income below the World Bank’s operational threshold for concessional support to qualify for debt service relief for up to two years.

This would apply when a life-threatening global pandemic is inflicting severe economic disruption across the Fund’s membership and is creating balance of payments needs on such a scale to warrant a concerted international effort to support the poorest and most vulnerable countries.

The IMF has also launched a fund-raising exercise that would enable the Trust to provide about $1bn for the current pandemic. Georgieva has called upon the Fund’s economically stronger member countries to help replenish the CCRT, which had only $200 million available for the world’s poorest countries.

The UK has responded with a pledge for £150m ($183m). Other donors, including Japan and China, are also coming forward with important contributions.

To protect the poor from the economic impact of the 21-day nationwide lockdown, the Narendra Modi government today announced a Rs 1.7 lakh crore Prime Minister Gareeb Kalyan Yojana. Finance minister Nirmala Sitharaman said the relief package includes direct benefit cash transfers, free LPG, grains and pulses for the poor while the middle class would be able to withdraw funds from their Employees Provident Fund (EPF) account.

Addressing the media during market hours, Nirmala Sitharaman said the government has been working to protect the interests of those affected directly since the coronavirus-induced lockdown. "We have come with a package which will immediately take care of the welfare concerns of the poor and suffering workers, and those who need immediate help," said the Finance Minister. 

The relief measures come at a time when hopes of a stimulus package to strengthen the economy against the coronavirus pushed equity markets higher and put them on track to close in the green for the third session in a row.
 
Many economists have awarned of a sharp economic impact of the outbreak on India, which is already staring at the worst pace of annual GDP expansion recorded in more than 11 years. 

Here are highlights of what the Finance Minister said: 

  • A package is ready for the poor, including migrant workers, urban and rural poor, who need immediate help
  • No one will go hungry
  • Package is worth Rs 1.7 lakh crore
  • Medical insurance cover worth Rs 50 lakh per person for those putting their own life at risk
  • These include doctors, paramedic/healthcare workers and ASHA workers dealing with coronavirus outbreak
  • 20 lakh workers to benefit from this initiative
  • 80 crore people to benefit from Rs 1.70 lakh-crore package under PM Garib Kalyan scheme
  • They will get either 5 KGs of rice or 5 KGs of wheat in next three months, in addition to existing allotment; 1 KG pulse of choice 
  • Not even one poor person will be left without food 
  • Cash transfer will be made under Direct Benefit Transfer (DBT) scheme
  • Wage increase under MGNREGA; from Rs 182 to Rs 202
  • 5 crore people to benefit, will lead to increase in income by Rs 2,000
  • Rs 1,000 additional amount to be provided to poor senior citizens, widows and disabled, in two instalments through DBT
  • 3 crore people will benefit from this measure
  • 20.5 crore Jan Dhan accounts held by women to be credited with additional Rs 500 a month through DBT
  • Two announcements fro organised sector: 
  • Government will pay EPF contribution (for 12% on behalf of employers and employees each) for next three months for establishments with up to 100 employees and 90 per cent of whom draw less than Rs 15,000/month; 80 lakh workers, 4 lakh organisations to benefit
  • EPF scheme regulation to be amended to permit withdrawal of up to 75 per cent of non-refundable advance or three months wages, whichever lower; 4.8 crore subscribers to benefit
  • Request state government to utilize District Mineral Fund for screening and testing

Punjab Chief Minister Captain Amarinder Singh has expressed disappointment over the announcements made by the Union Finance Minister, terming them as inadequate to address the concerns of the people, businesses and industry in the light of the COVID-19 pandemic gripping the nation.

The announcements made by Nirmala Sitharaman do not fully reflect the concerns in the prevailing situation, said the Chief Minister, underlining the need for a comprehensive package to build the confidence of all sectors of the economy and support the poor/underprivileged in this hour of need.

It was the need of the hour for the Centre to urgently come out with a detailed economic package without further delay, said Captain Amarinder, pointing out that the Finance Minister had failed to come out with details of the Task Force announced by the Prime Minister to work on such a package.

No suggestions had been taken so far from the states on the composition of the Task Force, nor any details shared, he said, hoping that it would be representative and would rise to the occasion triggered by this unprecedented crisis. Noting that Punjab had already sent in its suggestions to the Prime Minister and the Union Finance Minister on the interventions required by the central government, he expressed the hope those would be taken cognizance of.

The Chief Minister said he had hoped for more than mere postponement of date of filing tax returns. Even the due date has not been changed in spite of the fact that most states are under curfew/lockdown, he pointed out. Captain Amarinder said the Finance Minister had even failed to make any mention of EMIs on loan repayments and default.

There was no adequate attention being paid to the plight of the poor especially the unorganised workers, which all the states had been pressing for, said the Chief Minister. There was urgent need, he said, to double the PDS quota and provide free of cost ration at least for two months to the people in the prevailing situation, as already sought by the Punjab government.

Captain Amarinder pointed out that he had also sought from the Centre lump sum assistance for stakeholders in tourism and hospitality sector, such as taxi drivers, freelance tour guides, unregistered tour operators, dhabawala, restaurant, rehriwala, who had been severely hit by the lockdowns across states.
