WhatsApp can’t share user data With Facebook Collected before September 25: Delhi HC



WhatsApp cannot share its old user data with Facebook or any other platform, the Delhi high court ruled on Friday while allowing the popular instant messaging app to roll out a new privacy policy.

In order "to protect interest of users", the court directed WhatsApp to delete information and data of people who opt out of the service before September 25 and not to share it with social networking site Facebook or its group companies.

The court also asked the telecom regulator TRAI to examine the feasibility of bringing internet messaging applications like WhatsApp under the statutory regulatory framework.

WhatsApp revised its privacy policy last month to share data with owner Facebook and allow targeted ads and messages from businesses, laying the groundwork for the free messaging service to begin making money. Students Karmanya Singh Sareen and Shreya Sethi, 19 and 22 respectively, then filed a public-interest litigation -- akin to a class action -- seeking to block those changes. They wanted a rollback of those updates, in a lawsuit that's attracted attention as a test case for how legal authorities around the world may respond.

The messaging app has maintained all along that it does not retain user information on its servers once the account is deleted.

The petitioners’ lawyer said WhatsApp, which has about 70 million users in India, contended that user information is retained even after an account is deleted.

WhatsApp began operations in 2010. It was acquired Facebook in 2014 in a 19 billion dollar deal.

Facebook has a history of lawsuits over user privacy and advertising. In a 2011 settlement with the FTC, the company agreed that it would always ask users for permission before making changes to privacy practices.
